‘Subscriber’ is defined as a customer subscribing to EcoNote and/or EcoNote Pro and nothing else whatsoever.
‘Archive Registration ’ is deemed to include registration for unlimited access to the Archives section of the Ecobody website (and no other part therof ) for private individual use only when accompanied by the required fee, except as otherwise explicitly agreed in writing by Ecobody Limited together with payment of any required additional fee. Any such registration will remain current for a period not exceeding 12 months. When registering for access to the archives the customer expressly agrees to abide by all those applicable restrictions below addressed to Subscribers and in particular to those referring to limititions as to copyright, use and further circulation of all archive material so accessed during any subscription or registration period and also thereafter.
Registration for one service on the Ecobody website confers no entitlement to any other service unless covered by a separate agreement. Registration for access to the archive material on the site, for example, does not confer any subscription rights to other published material such as Econote or any Ecobody reports or other such material accessible through the Member Area of the website.
The Subscriber . The Subscriber agrees to pay the full payment for the chosen subscription package for the period subscribed to. Except where otherwise agreed, this will be for a period of 12 months commencing from the date of application.
Subscription Entitlement. In subscribing to EcoNote Pro, the subscriber is entitled to receive, from Ecobody Limited, unlimited access to the on-line on-line journal (subject to reasonable service availability) for the period of the subscription. Subscription to the free, unpaid for, version ofEcoNote may be terminated at our discretion without notice.
Subscription Period - Except where otherwise agreed the subscriber agrees to subscribe for not less than 12 months service.
The Subscriber to EcoNote Pro is entitled:
1. To receive access to the EcoNote Pro on-line publication for the period of his subscription period subject only to reasonable service availability;
2. To grant access or otherwise distribute material from the EcoNote Pro world wide web site up to the total number of users applicable to the subscription package paid for (Corporate Membership - unlimited; Business Subscription - up to 5 employees within the subscribing organisation; Academic and Institutional - limited only to staff and students within the subscribing organisation; Personal - usage restricted to the subscriber; Student - usage restricted to the subscriber and while a student on a recognised course of study).
3. To receive a weekly E-mail update delivered to the subscribers' primary e-mail address (which the subscriber may subsequently re-distribute to up to 4 e-mail addresses only within the same subscribing organisation, if applicable. No such redistribution rights, however, apply to personal or student subscriptions.
4. To receive access to discussion forums,events diaries and reports as deemed part of the current subscription pachage by the Editor of EcoNote Pro.
5. Corporate and Business level subscribers are entitled, in addition to make use of the 24-hour enquiry service in accordance with their subscription package. Enquiries must be submitted through the on-line enquiry form within the Member Area of the web site (www.ecobody.com). Corporate and Business level subscribers are entitled to 20 and 10 free enquiries responded to by Ecobody within 24 hours. Additional enquiries may be charged for.
The Subscriber Agrees to abide by the terms and conditions of subscription to EcoNote and/or EcoNote Pro. In particular the subscriber expressly agrees not to disseminate the contents of EcoNote or EcoNote Pro to any other person or organisation without the specific written permission of ecobody limited.
Copyright. The Subscriber expressly recognises the copyright of ecobody limited to material appearing and distributed within the EcoNote and EcoNote Pro on-line publication. The Subscriber will be responsible for any breach of copyright occurring by unlicensed distriuion of EcoNote or EcoNote Pro material.
Refunds of Subscription Charges in the Event of Early CancellationIn the event of cancellation of subscription before the expiry of 12 months since commencement of subscription, refunds of subscriptions will be made in accordance with the following scale: Within 3 months of commencement of initial subscription date- 50%; Between 3-6 months of commencement of initial subscription date - 25% ; Later than 6 months commencement from initial subscription date - 0%. In any subsequent subscription year, a refund of 5% of the outstanding subscription will be paid for each remaining unused subscription month. In each of the initial and any subsequent subscription years an administrative charge of £20 will be charged against that year's subscription for early cancellation.
For archive registration, where a fee is paid, a maximum of 50% refund will be payable provided any such claim is made within 15 days. No refund will be payable after 15 days given that unrestricted access to the archive material will have been available up to that time. A charge of £15 will in any event, be applied to any such registration subsequently cancelled for whatever reason.
Refusal of subscriptions. Acceptance of subscriptions or registrations for any service provided from the Ecobody website are provided by the grace of the company and may be refused if the customer/applicant is deemed unsuitable for any reason and without further explanation. Subscriptions will not, however, normally be refused.
Applicable Law Subscriptions to EcoNote and/or EcoNote Pro are entered into in accordance with the laws and regulations applying in England and Wales and absolutely in respect of no other State.
